Division of Property

 

Oregon is NOT a community property state.  In Oregon property is divided using a system of equitable division of property between the divorcing spouses.  Equitable means “fair” rather than equal.  


The court makes decisions about what is equitable based on the circumstances of the divorce, which include non-financial contributions to the marriage as well as financial.  The court presumes that both spouses have contributed equally to the acquisition of property during the marriage, whether or not the property is jointly held, and therefore should be divided equitably.  In addition, the court will consider tax implications of the division of the assets.
